Negotiated rulemaking committee will meet Sept 8-9 in Avon

The sixth meeting of the regulatory negotiation
committee that is charged with developing a long-term plan for ORV
access on the Cape Hatteras National Seashore will be Monday and
Tuesday, Sept. 8-9, at the Avon Fire Hall.
The public can attend the meetings, which begin at
8:30 a.m. both days, and can also comment. The times for public comment
periods are:
• Monday, Sept 8, at noon
• Monday, Sept 8, at 5:30
p.m. (if all comment is not completed before lunch)
• Tuesday, Sept. 9, at
noon
According to the information released by the National Park Service, the
goals of the September meetings will include a review of the results of
an evaluation by the Department of Interior Office of Collaborative
Action and Dispute Resolution on whether the negotiated rulemaking
process should continue.
At the request of Cape Hatteras National Seashore Superintendent Mike
Murray, the DOI office has interviewed participants over the summer on
how committed they are to continuing the negotiating process. Murray is
expected to address the office’s recommendation on Monday
morning, Sept. 8
Also, the proposals of the subcommittees will be made public and discussed by the full committee.
The entire committee has not had a meeting, since early June, but
various subcommittees have been meeting in person and by phone
conference calls during the summer.
The subcommittees and their members are:
• ORV Routes and Access. David Goodwin, Frank
Folb, Jim Keene, Burnie Gould, Destry Jarvis, and Sidney Maddock
• Vehicle Characteristics and Operations,
including night driving. Renee Cahoon, Jim Keene, Patrick Paquette,
Derb Carter, and Neal Moore
• Permits, Fees, and Passes. Renee Cahoon,
Michael Peele, Patrick Paquette, Dwight Rettie, Destry Jarvis,
and Derb Carter.
• Village Closures. Jeff Wells, Roy Kingery,
Sonny Duke, John Alley, Jim Lyons, Steve Kayota or Vincenzo
Sanguinetti, and Wayne Mathis.
• Natural Resources. Issues/desired future
conditions, buffer zones, closures, resource management. Judy
Swartwood, Larry Hardham, Bob Eakes, Walker Golder, Rob Milne, Jason
Rylander, David Allen, and David Rabon.

The committee will also discuss a proposal by Dare County to videotape
both days of the negotiated rulemaking committee meetings for airing on
the public access channel, Channel 20 on Charter Cable, and perhaps for
airing on the county’s Web site.
Warren Judge, chairman of the county’s Board of Commissioners,
made the proposal to Mike Murray. The county committed to pay for the
cameras, microphones, and personnel that will be necessary, and Judge,
who is a member of the committee, had hoped to start videotaping at the
September meeting.
However, Murray said he wanted to discuss the issue with the entire
committee before any videotaping is done. He is concerned that
videotaping could have a “chilling effect” on the committee
members – even though committee meetings are open to the public
and the media, and comments from the committee are regularly reported
in the press and on message boards.
The schedule for negotiated rulemaking meetings for the rest of the year is:
• Oct. 22-23 at the Hatteras Village Civic Center.
• Nov. 14-15 at the Clarion Hotel in Kill Devil Hills.
• Dec. 11-12 at the Avon Volunteer Fire Department.
